Terms of Service

Two things are covered here: the free tools, which you may use with almost no strings attached, and agent kits, which you design, buy and download on this site without talking to anyone.

1. The free tools

Business Scan, Agent Designer and App Builder are provided free, with no account, and as is. You may use their output for any lawful purpose, commercial included. Nothing is charged and nothing is owed.

They produce estimates, not facts

These tools are powered by AI language models. Their output is generated, not verified. Specifically:

• Every financial figure they show is a projection modelled from public industry benchmarks, never a measurement of any real business's revenue, costs or performance. They are labelled as such throughout, and they should not be relied on as valuations, forecasts or a basis for investment.
• Findings about a business, including a competitor's, are inferences drawn from a public web page. They may be wrong, out of date, or incomplete.
• Generated code and architecture are starting points. Review, test and secure anything before putting it into production.

None of it is professional advice: not financial, legal, tax or engineering advice. Decisions you make from it are yours.

Using Business Scan responsibly

Business Scan reads publicly accessible web pages, exactly as your browser would. You agree not to point it at material you are not entitled to access, to use it in a way that violates a target site's terms, or to use it for harassment, misrepresentation, or any unlawful purpose. Do not use it at a volume intended to burden another party's systems.

Your own AI key

The tools run on an AI provider key that you supply and that stays in your browser. You are responsible for that key, for keeping it secret, and for any cost or limit your provider applies. BlvkWare never receives it and cannot be responsible for its use. Your use of the provider is subject to the provider's terms.

Availability

The tools depend on third-party services, including AI providers and, for Business Scan, public page-relay services. Those may change, rate-limit or disappear without notice. No uptime is promised, and the tools may be changed or withdrawn at any time.

2. Agent kits

What a kit is

A kit is a set of files generated from the design you make on the kit page: the agent's instructions, its tool definitions, its workflows, the schemas for the records it keeps, its autonomy policy and guardrails, setup and integration notes, and acceptance tests. The full list of files is shown before you buy.

A kit is a specification, not running software and not a service. It contains no credentials and connects to nothing by itself. Buying one does not include hosting, building, integration, configuration, support or any other work. You, or whoever you choose, build the agent from it.

Price, and which kit a design needs

Prices are shown on the site. Which kit a design needs, Operator or Deputy, is worked out from what the design covers rather than chosen, and the kit page shows which one and why before you pay. A Deputy key also unlocks any design that needs only an Operator kit.

Payment and your licence key

Purchases are processed by Gumroad, under Gumroad's own terms, and Gumroad issues your licence key. BlvkWare checks that key with Gumroad each time it is used.

Downloading

One key is one agent. The first download binds the key to that design's role. After that you may change the design and download again, up to 20 downloads in total, but a different role needs another key. BlvkWare does not keep a copy of your design or your kit, so keep what you download.

Refunds

Refunds are handled through Gumroad, under the refund policy shown on the product page when you buy. A refunded or disputed purchase stops its key downloading.

What you may do with a kit

You may use it, change it and build on it for your own business, with any tool, framework or vendor, for as long as you like, and you may give it to someone you hire to build your agent for you. You may not resell or redistribute the kit, or files generated from it, as a product of their own. Nothing in a kit gives BlvkWare any rights over your data, your customers or your business.

Your responsibilities

How the agent is built and run is under your control, and so is the responsibility for it. That includes the access you grant it, reviewing what it does, and keeping a person responsible for it. Messaging in particular is subject to law, including consent and opt-out requirements for automated texts and calls. Building an agent that complies and operating it lawfully is your responsibility as the sender.

4. Liability

To the fullest extent the law allows, BlvkWare is not liable for indirect, incidental or consequential loss, including lost profit, lost data or business interruption, arising from the tools, the kits, or any agent built from a kit. For a kit, total liability is capped at the price you paid for it. The free tools are supplied without warranty of any kind and carry no liability.

Nothing here excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.

5. Privacy

What is and isn't collected is set out in the privacy policy, which forms part of these terms.

6. Changes and governing law

These terms may be updated; the date at the top will change and the current version governs use from that point. A change does not alter the terms of a kit you have already bought.

BlvkWare operates from the State of Mississippi, United States, and sells to businesses throughout the country. These terms are governed by the laws of the State of Mississippi, without regard to its conflict-of-law rules, and the state and federal courts located in Mississippi have exclusive jurisdiction over any dispute arising from them. Where your own local consumer-protection law grants you rights that cannot be waived by agreement, nothing here removes them. If any provision is found unenforceable, the rest continues to apply.
